TWO former Surrey police officers have been branded "a disgrace" and jailed for 15 months each for having sex with a woman while on duty. Pc Andrew Lang, 31, who was brought up in Passfield but is now of Overdale Walk, Whitehill, and Pc Mark Witcher, 30, were both found not guilty of raping and indecently assaulting a young hairdresser hours after she had been assaulted outside a nightclub. However, Lang and Witcher of Drayton in Portsmouth, were sent to prison following convictions for wilful misconduct in public office for having sex with the woman while on duty. Jailing the pair, the judge described their behaviour as "sordid" and told them they had discredited the police uniform. And this week it was revealed that police chiefs had uncovered further allegations of misconduct against the pair, understood to be of a sexual nature. Monday's verdict followed a 10-day retrial at Winchester Crown Court. The court had heard that in September 2003, the pair had a threesome with a woman, then 23, at her home in Godalming. The officers had taken her home after she was attacked outside a nightclub. The two officers then said that the mother-of- three flirted with them, seduced them and consented to sex with both of them. However the woman, who had drunk 12 double vodkas and Red Bull that night, said that she was raped by the pair and forced to perform sexual acts while her children slept upstairs. The allegations came to light after the pair boasted about having a threesome to colleagues and an investigation was launched. When the woman was interviewed, she said she had not made a complaint earlier because she feared no one would believe her. As the jury foreman delivered the unanimous verdicts Witcher's eyes filled with tears and he bowed his head while Lang closed his eyes and nodded his head repeatedly. The alleged victim, now aged 25, sobbed uncontrollably and was helped from the public gallery of the court by police officers. At an earlier trial last year, a jury had failed to agree verdicts on the same rape and indecent assault charges but found them guilty of misconduct. On Monday, at the conclusion of the retrial, The Honourable Mr Justice Nigel Davis sentenced them for misconduct. "I think that the public is entitled to know that the court will take a severe view of police officers breaching their duties towards victims of crime," he said. "During the course of this trial you variously described your conduct as inappropriate, an error of judgement or a big mistake. I regard those as weasel words. "What you did in my view was a disgrace and you have brought great discredit on yourselves, on the uniforms you were wearing that evening and by association on Surrey Police Force. "I accept that you are now remorseful but you were not at the time. On the contrary it was the bragging about what you had done that finally exposed you. "Members of the public, particularly those who are the victims of a crime, are entitled to put their trust in the police. You abused that trust." Both men were sacked in December last year after a disciplinary hearing conducted by senior officers from another force. Surrey Police Authority is now applying to the Home Office to remove their pension rights. After the case, it emerged that the pair were being investigated following further allegations of misconduct. A Surrey Police source said: "After we started this investigation we uncovered a number of other matters while they were serving officers which were of a disciplinary nature. "These were not criminal matters but were of a sexual nature. They relate to things they did independently with members of the public while on duty. "We ended these investigations when Witcher and Lang were sacked after the misconduct convictions." This week, the Assistant Chief Constable of Surrey Police, Mark Rowley, pledged that his force would not tolerate anything but the highest standards of behaviour from its officers and staff. "Firstly I want to say that the Chief Constable has already met and personally apologised to the young woman who was the victim of the disgraceful behaviour of these two former police officers," he said. "She is a survivor who has displayed huge courage and determination in giving evidence twice. She has my admiration. "The whole force shares my disgust at the abhorrent behaviour displayed by Witcher and Lang towards a vulnerable victim of crime. "Surrey Police is absolutely determined to maintain the highest standards of integrity and trust that the public rightly expects. "I am proud of the fact that other police officers had the courage to come forward to report their suspicions and then testify against the defendants. "Witcher and Lang have undermined public trust and the reputation of Surrey Police and they will now pay a very heavy price. I welcome their conviction and imprisonment. "I am determined not to let the inexcusable actions of these two individuals undermine the very professional work that is carried out daily by my police officers and staff who serve the public with courage and dedication."
