WAVERLEY Borough Council will not appeal against the judgment handed down over Undershaw at the High Court.
The judge in the case, which was heard on May 23, overturned the borough council's decision to grant planning permission for the historic home of Sir Arthur Conan Doyle at Hindhead to be developed into eight homes. Permission was granted in June 2010.
But Undershaw's owners Fossway, based in the British Virgin Islands, is seeking permission to appeal.
Undershaw Preservation Trust co-founder Lynn Gale told The Herald: "This could mean that the case of Undershaw could be taken to the Court of Appeal, which Conan Doyle had a hand in founding in 1907 with the George Edalji case – Doyle's one and only 'real live' case."
